On Point Claim Form Settlement over Data Leakage

Conway Data Breach Settlement

On Point Global publishes various digital and online editorial guides on a variety of subjects like finance, automotive, homes, legal services, community issues, travel, recreation, and marketplaces. The company captures consumer data and uses that information to identify various consumer behaviors. However, a $102 million Federal Trade Commission (FTC) lawsuit has been filed against On Point Global alleging the company engaged in fraudulent website schemes.

Consumers will become eligible for the benefits of this class action settlement if they bought a guide in 2017, 2018, or 2019 from On Point Global and were not satisfied with their purchase. Claims can also be filed by consumers who provided their credentials to On Point Global in 2019 but were dissatisfied with their experience.

Plaintiffs have accused the company of misleading its customers into sharing their credentials. In December 2019, FTC sued On Point Global for promising them a quick and easy way of completing various government services like checking eligibility for government programs and renewing their driver’s license. The language and branding of these websites were such that they convinced customers into sharing sensitive credentials like personal identifying information, credit card data, and more.

According to FTC, once consumers shared this sensitive data, they started receiving harassing marketing text messages and emails from third parties. The federal regulator further added that these messages started when On Point Global sold sensitive consumer data to third parties in exchange for millions. A preliminary injunction was requested by FTC against On Point Global to shut down the allegedly fraudulent websites that the court agreed to in February 2020 after finding that FTC would most probably prevail in the trial by proving that the websites were patently misleading. The court ordered On Point Global to pay $102 million to affected consumers with its November 2021 ruling.

According to the terms of the judgment, affected consumers are eligible for a cash payment. However, the payment amount will vary according to the amount of personal information offered by each consumer to On Point Global and the number of claims filed. Class Members providing more information might be eligible for larger payments than the ones who shared a small amount of information. Consumers who have already received a refund from the company will get smaller payments from this judgment. As per the judgment website, payments shall not exceed $15 and Class members should submit a valid claim form for receiving the benefits of this settlement.
