Sole Fitness is a home gym company selling ellipticals, treadmills, climbers, bikes, and rowers. It also offers fitness classes through a membership program. A $3.65 million lawsuit has been filed against Sole Fitness alleging the company has exaggerated the horsepower and performance of its treadmills for boosting consumer sales. According to the 2020 class-action lawsuit, Sole Fitness tried to convince customers for purchasing its equipment and driving up prices by inflating the horsepower rating of its treadmills. The plaintiffs in the case have argued that the horsepower of a treadmill affects its performance and has a big role to play in determining consumer purchases.

Sole Fitness is known to have marketed its treadmills with continuous horsepower ratings that can be obtained in lab settings with high power input rather than providing accurate horsepower ratings that can be obtainable during household use. The plaintiffs have added that no household can attain the marketed horsepower rating. The treadmill class-action lawsuit contends that Sole Fitness has deceitfully outpaced its competition using false and misleading horsepower ratings which tried luring consumers into buying treadmills and paying an exaggerated price based on the horsepower misrepresentations.

Despite not admitting any wrongdoing, Sole Fitness has agreed to resolve all allegations brought against them with a $3.65 million settlement. The settlement also includes injunctive relief as Sole Fitness has agreed to stop using continuous horsepower ratings in marketing its treadmills. The company will also provide a disclaimer on horsepower representations in all its marketing and advertising. The Class Counsel will request an award of attorney’s fees amounting to 1/3rd of the Common Fund, reimbursement for litigation costs, and expenses totaling not more than $130000 from the Court. A service award worth $5000 will also be requested by the Class Counsel to be paid to both the Class representatives.

All the service awards, class counsel’s fees, and costs to administer the settlement awarded by the court will be financed from the Common Fund. The last date for the Class Counsel to file a Fee Application for an award of Attorney’s expenses and fees, including notice and administrative expenses is 7th September 2022. Class members won’t be held personally liable for the attorney’s fees or expenses.

Eligibility For Making Claim: The terms of this settlement are expected to benefit Class Members who bought a Sole Treadmill between 30th August 2015 and 21st February 2022 in Minnesota or Ohio and between 2nd December 2017 and 21st February 2022 in the remaining United States.

  • Sole TT9 (4.0 CHP) models

The Class does not constitute Defendant and its directors, officers and employees, Class Counsel and their associates, partners, employees and lawyers and the judicial officers, their immediate family members, and associate Court staff to whom this case has been assigned.

Proof Of Purchase: The serial number of the treadmill will be required if you didn’t receive direct notice.

Potential Claim Amount: Settlement Class members submitting a valid claim form will be eligible to receive a $100 Sole Fitness gift card and cash payment. The cash payment will be determined by the number of Class Members participating in the settlement. You can expect the payment to be lower if more Class Members participate in the settlement. The cash payment will be made from the $3650000 common fund which has been arrived at after deducting expenses, fees, and administration costs. However, the $100 Sole gift card for each Class Member is fixed irrespective of the number of consumers participating in the settlement. These gift cards can be transferred and used for placing a one-time purchase on the Sole Fitness website subject to certain date restrictions.
