Buck Knives Class Action Settlement for False Marketing

A class-action lawsuit has been filed against Buck Knives claiming that it falsely marketed its products as “Made in USA.” This $200000 lawsuit is expected to benefit consumers who bought one or more Buck Knives knife-sheath combinations between 1st March 2008 and 17th February 2022. Buck Knives is a reputed manufacturer of knives, including pocket knives, hunting knives, cutlery, fishing knives, and even custom knives. The company uses premium-grade materials in manufacturing its knives which undergo refined processes and have thoughtful designs. However, Buck Knives have been alleged to falsely advertise its products as “Made in USA” for charging a higher price from its customers.

The knives were manufactured in America, but the sheaths were imported as per the lawsuit. This gave adequate ground to the consumers to contend that Buck Knives illegally marketed the combination products as “Made in USA.” The plaintiffs further argued that this misleading advertising caused them to pay a higher price for the combination products than what they would have paid if they had clear knowledge about the products’ origins. Although Buck Knives have not admitted to any wrongdoing, they have agreed to honor the $200000 settlement for resolving the allegations made by the plaintiffs.

The Class Members are eligible to receive cash payments for every knife purchased. You can either file a claim to benefit from the terms of the settlement, do nothing, and remain to be a part of the class, exclude yourself from or object to the settlement. If the court approves the settlement and you do not exclude yourself, then you will be bound by the judgments and orders of the court even if you do not file a claim. If you have any legal action against the defendant related to the allegations in the lawsuit, then that will be released once the settlement receives the court’s approval.

Eligibility for Making Claim: The benefits of this class action settlement is applicable to consumers who bought at least one or more Buck Knives knife-sheath combinations for personal use between 1st March 2008 and 17th February 2022. This pertains to the following

All persons who submit a valid request within the due date for exclusion from the Settlement Class are excluded from the purview of this Settlement Class.

Proof of Purchase: Class members have to submit either a proof of purchase or a photograph of each knife-sheath combination claimed which depicts the claimant’s photo identification in any form or a stamp on the right side of the knife blade.

Potential Claim Amount: Class Members who submit a valid claim within 1st June 2022 will receive a maximum of $10.00 per qualifying Buck Knives knife-sheath combination bought for personal use with a maximum ceiling of 3 knives per person and 6 knives per household. The payments made to eligible class members will depend on the number and amounts claimed by all Class Members after other deductions and adjustments specified in the Settlement Agreement have been put into effect. On approval of the claim, the amount shall be remitted either electronically or via cheque. The Settlement Administrator has the right to request verification of purchase of the subject products, including, but not limited to other documentation like receipts demonstrating purchase of the subject products during the class period before honoring the class member’s claim.

Final Hearing Date: A final approval hearing shall be held by the court on 8th August 2022 at 1:30 p.m. to decide whether the settlement is reasonable, fair, and adequate. Here the Court shall also decide whether or not it will approve the Class Counsel’s attorney’s fees and expenses ranging up to $100000 and if $7500 will be awarded to the Representative Plaintiff.
