$25M Terminix Fund Alabama Settlement for Overcharged Renewal Price

A Terminix settlement worth $25 million has been reached for resolving claims of plaintiffs accusing the company to charge high renewal prices from its customers for offering termite protection. Terminix class action lawsuit also states that the company has falsely advertised its services. The terms of this settlement are expected to benefit both existing and former customers of Terminix residing in Alabama. 

The Alabama attorney general filed the Terminix class-action lawsuit alleging the company for violating the state law. It pointed out that the company violated state law as it failed to perform proper termite treatments on the buildings of customers. Terminix also failed to inform customers about the nature of the treatment, perform annual inspections as per requirement and provide no-cost treatment. They charged higher prices from customers in 2019 without offering any incremental service. Overall, the company failed to properly handle claims of termite damage in a complaint and timely fashion. 

Eligibility for Making Claim: Both existing and former Terminix customers in Alabama are eligible for the benefits of this class action settlement. 

Proof of Purchase: No Proof of Purchase is required though some claimants need to fill out a claim form. You can click here to check whether or not you require to file a claim form. Existing customers eligible for refunds do not have to submit any claim form. The refund shall be computed and sent by the Receiver, a neutral third party that will act as the court’s agent. Both sections 1 and 2 of the claim form’s Attestation section will have to be completed by the former customers. Former or existing customers trying to get a claim from property damage have to complete sections 1 and 3 alongside the Attestation section. No property damage claim forms should be sent by the class members to the receiver unless they have primarily tried resolving the dispute with Terminix. 

Potential Claim Amount: 

  • Existing customers of Terminix in Mobile or Baldwin countries or serviced by the Monroeville, Alabama, office, are entitled to free treatment if they didn’t have their property treated by Terminix over the last seven years. 
  • Existing customers in Mobile or Baldwin countries will be entitled to a refund if they paid an increased annual renewal price in 2019 and 2020 for termite protection. 
  • Former Terminix customers residing in districts that terminated their contract with Terminix in 2019 or 2020 are eligible for either a reinstatement with Terminix at their 2018 price or a one-time payment of $650 alongside free termite treatment.
  • Both existing and former customers residing in Alabama owning a Terminix-serviced property that might contain termite damage will also be entitled to receive payment for the same. 
  • Apart from the monetary relief under the Terminix renewal lawsuit settlement, the company has shown a green signal to a seven-year payment increase cap limiting its contract to 5% plus the CPI (Consumer Price Index).

Deadline For Submitting Claim: Though there is no deadline to submit the claim form, the Terminix class action settlement fund will expire by 1st December 2022.
