TicketsOnSale has agreed to resolve claims that it failed to refund ticket sales for canceled events with a $4.1 million settlement. The terms of this settlement will benefit consumers who bought a ticket before 17th August 2022 through OnlineCityTickets.com and/or TicketsOnSale.com to an event that was scheduled between 23rd March 2017 to 17th August 2022 which got postponed, canceled, or rescheduled to a date that hasn’t yet occurred.

Third-party resellers list their tickets for sporting events, concerts, and other events on TicketsOnSale.com. Another similar ticket resale website is OnlineCityTickets.com. A class action lawsuit was filed in 2022 against both these ticket websites claiming they violated the terms of use by failing to refund customers for rescheduled or canceled events. The defendants promised a “100% Buyer Guarantee” for all the tickets bought through their websites but they failed to act upon their promises and even refused to refund the plaintiffs for the canceled events. Rather, they issued credits through which tickets could be purchased from the website for future dates.

Under the settlement terms, class members can receive a cash payment or use the credits they were awarded by the ticket website. Cash payments will be equivalent to the price paid for tickets bought including delivery charges, and fees after deducting money paid using credits or gift cards. Customers have been issued credits equivalent to 120% of the ticket’s original purchase price. The class members who bought tickets for the canceled events should have already received credits towards the purchase of tickets from the website. The last date for availing of the active credits through the website is 31st January 2023.

California residents are eligible to receive only cash payments from the settlement. The payments made to customers might be reduced on a pro-rata basis if the settlement class members claim more than $4.1 million from the cash fund thus resulting in smaller cash payments. But in this case, they will retain a part of their existing credits to compensate for the reduced payments. Class members who wish to retain their ticket credits rather than receive cash payment don’t need to submit any claim form.
