Nissan has agreed to resolve a class-action lawsuit brought against them with a $2.2 million settlement. The lawsuit claims that the carmaker violated federal laws by making unsolicited telemarketing phone calls. Terteryan TCPA settlement<\/a> terms will benefit individuals who received an automated call regarding an auto financing account from Nissan Motor Acceptance Corp between 24th March 2012 and 3rd October 2019 although they weren\u2019t part of any such agreement.<\/p>\n

Nissan is a popular automobile brand that manufactures and sells a number of vehicle models. A class-action lawsuit was filed against Nissan as numerous consumers received unsolicited phone calls from the company although they didn\u2019t have a financing agreement with Nissan or owned any Nissan vehicle. Individuals purchasing vehicles directly from Nissan may receive phone calls from the dealer to discuss their financing account. But the plaintiffs received telemarketing calls about an account that wasn\u2019t theirs.<\/p>\n

Nissan allegedly called the plaintiffs to enquire about the account although the plaintiffs didn\u2019t give any prior written consent to receive automated calls from the car seller. This started after a borrower lagged behind on payments. Some plaintiffs received more than 20 automated calls from Nissan for someone else\u2019s account. These calls were in violation of the federal Telephone Consumer Protection Act (TCPA) which protects consumers from automated or unsolicited telemarketing calls, faxes, and text messages.<\/p>\n

TCPA makes it mandatory for businesses to get prior written permission before sending these communications to consumers. Not conforming to the same can result in penalties worth thousands of dollars. Nissan has agreed to resolve all allegations brought against it with a $2.2 million class-action settlement<\/a> though it hasn\u2019t admitted any wrongdoing.<\/p>\n

Class members become eligible for cash payment under the terms of the Nissan settlement. However, the exact payment amount will vary according to the number of class members participating in the settlement and the net settlement fund remaining after fees and other deductions. The second round of cheques might be issued if cash funds remain after the first round of settlement cheques.
