A class action settlement claim has been brought against SCR Medical Transportation accusing them of failing to pay the minimum wage due to workers for off-the-clock work. They have agreed to honor the terms of the settlement with a $1.2 million payout. The terms of the settlement<\/a> are expected to benefit employees of SCR Medical Transportation working as medical van drivers since 20th May 2016 who experienced waiting in line with a mobile data terminal device exceeding 15 minutes either before or after their shifts.<\/p>\n

SCR Medical Transportation offers reliable transportation to disabled individuals by offering them access to family, friends, and medical services. The SCR drivers are responsible for plying their clients safely and efficiently to their destination. As per the class action lawsuit, SCR made its workers work off the clock regularly before or after their shifts. The drivers had to wait in line for more than 15 minutes per shift or after clocking in or out on the mobile data terminal device in each van. SCR had allocated 15 minutes per shift for the waiting time while accounting for its driver\u2019s wages. However, the drivers alleged that they had to wait for more than 15 minutes regularly which resulted in off-the-clock work.<\/p>\n

The class-action lawsuit alleged that SCR violated the Illinois minimum wage law<\/a>, the federal Fair Labor Standards Act, and Chicago\u2019s Minimum Wage Ordinance. Though SCR Medical Transportation hasn\u2019t admitted any wrongdoing, they have agreed to resolve the allegations with a $1.2 million settlement. Under the settlement terms, class members are eligible to collect payments varying according to the amount of time spent in line either before or after their shifts. Though this time hasn\u2019t been recorded, 20 minutes will be added to every eligible workweek for determining the amount due to each class member in overtime pay and back wages.<\/p>\n

Class members who were mailed the settlement notice received a claim form including their payment estimate though no other estimates are available. One-third of each settlement payment will be considered as wages and subjected to tax withholding resulting in a W-2 form. The remaining two-thirds portion of each payment will be considered as interest and penalties resulting in a 1099 form and won\u2019t be subjected to tax withholdings. Plaintiffs won\u2019t be able to enjoy the settlement benefits if they exclude themselves from the same, However, they will continue enjoying all legal rights against SCR Medical Transportation. Class members aren\u2019t required to attend the final hearing to enjoy the settlement benefits.
