NoTax4Nash is a Nashville movement passed by the metro council in 2020 for protesting against a 34% increase in property tax. The main aim of the group was to protest against the tax hike by ousting Mayor John Cooper who announced that the tax rate would be reduced back to its previous figure after the repeated crises in 2020.<\/p>\n

The class action lawsuit has alleged that NoTax4Nash violated federal laws by petitioning for participation in the movement. Thousands of Nashville residents received an automated phone call in July 2020 encouraging them to sign the petition against Cooper. According to the plaintiffs in the case, the call said it was sponsored by NoTax4Nash.<\/p>\n

The plaintiffs have alleged that NoTax4Nash violated the federal Telephone Consumer Protection Act (TCPA<\/a>) by calling consumers without their consent. As per TCPA, businesses need to take prior express written consent before contacting consumers with spam texts, robocalls, or automated faxes. NoTax4Nash allegedly violated these rules and that\u2019s why plaintiffs in the class action lawsuit have sought thousands of dollars per violation as allowed under the legal provisions.<\/p>\n

The defendants have agreed to resolve the claims of the class action lawsuit by paying $10,10,050 though it hasn\u2019t admitted any wrongdoing. According to the settlement terms, the class members are eligible for a cash payment. The class attorneys revealed that payments can range between $10 to $80 depending on the number of consumers participating in the settlement. Thus, higher participation shall result in lower individual payments.<\/p>\n

Irrespective of the payment amount, the attorneys working on the case revealed that the settlement<\/a> provides adequate monetary relief and ensures that Nashville voters aren\u2019t bothered by these types of automated calls again. Leftover funds resulting from the uncashed cheques will be paid to an unspecified charity. In no case will the funds be reverted to the defendants.<\/p>\n","protected":false},"excerpt":{"rendered":"
